THESE PEOPLE ARE GUARDIANS AND ATTORNEYS WHO ARE ALLOWED TO FLEECE YOUR ESTATE THE VERY SYSTEM SET UP TO PROTECT VULNERABLE PEOPLE AND THEIR MONEY IS BEING DELIBERATELY USED INSTEAD TO STEAL LIVES AND PROPERTY UNDER THE “GUISE OF PROTECTION” AND “COLOR OF THE LAW” FIRST THEY TAKE AWAY ALL YOUR RIGHTS TO LIBERTY AND PROPERTY OFTEN WITHOUT DUE PROCESS OF LAW AND THEN THEY CAN LOOT YOUR ESTATE THROUGH BILLING FOR SERVICES YOU DO NOT NEED. THIS OCCURS THOUGH A LEGAL SYSTEM KNOWN AS ADULT GUARDIANSHIP OR CONSERVATORSHIP AND THE STATE AND FEDERAL COURTS ARE ALLOWING IT ! THE PERPETRATORS DO IT ….. BECAUSE THEY CAN … WITH IMPUNITY ! ALL THEY HAVE TO DO IS SAY YOU HAVE A DIMINISHED CAPACITY ??? AND WHAT DOES THAT REALLY MEAN ? WHERE’S THE DEFINITION ? THAT’S ALL IT TAKES FOR A STRANGER TO CONTROL YOUR LIFE AND MONEY AND NO ONE WILL HELP YOU OR STOP THEM ! YOUR KIDS WILL BE CALLED GREEDY AND ACCUSED OF ONLY WANTING YOUR MONEY AND PREVENTED FROM HELPING YOU ! THEIR LIVES AND THEIR FAMILIES WILL BE DESTROYED ! YOUR POWER OF ATTORNEY WILL BE POWERLESS TO HELP YOU ! ANY GUARDIAN YOU NAMED WILL BE PREVENTED FROM HELPING ! THE COURT WILL DENY YOUR FAMILY AND FRIENDS THE RIGHT TO BE YOUR GUARDIAN. THE COURT WILL IGNORE YOUR ADVANCED DIRECTIVES, IF YOU HAVE MONEY. INSTEAD THEY WILL APPOINT A STRANGER WHO YOU WILL HAVE TO PAY FOR AND WHO WILL HIRE ATTORNEYS THAT YOU HAVE TO PAY FOR EVEN THOUGH YOU DID NOT HIRE THEM AND YOU WILL NOT EVEN BE INFORMED THAT THEY ARE BEING PAID OR HOW MUCH ! IT WILL BE AN OUT FEEDING FRENZY THE MORE MONEY YOU HAVE THE GREATER THE RISK HAVING A TRUST WILL NOT HELP YOU ! THEY WILL BUST IT ! YOUR HEIRS WILL GET NOTHING AND WILL HAVE TO USE THEIR OWN MONEY TO FIGHT FOR YOU. THEY CAN CHARGE WHATEVER THEY WANT AND THE JUDGE WILL APPROVE IT TO BE PAID FROM YOUR ESTATE. THEY CAN AND WILL OFTEN KICK YOU OUT OF YOUR HOME AND SELL IT WHILE PUTTING YOU IN A NURSING HOME. IF YOUR KIDS OR LOVED ONES COMPLAIN THEY WILL BE DENIED THE RIGHT TO VISIT YOU AND YOU WILL BE ALONE, SO THEY WILL REMAIN SILENT. THESE ARE THE HARD CRUEL FACTS OF GUARDIANSHIPS THESE FACTS ARE BASED ON HUNDREDS OF REAL LIFE CASES We can only conclude it is legal to steal from disabled and vulnerable elderly adults ! BECAUSE EVERYONE KNOWS IT IS HAPPENING AND NO ONE WILL STOP IT ! NOT THE STATE COURTS It is the State Courts that are allowing the abuse and financial exploitation everyday and refusing to stop it. NOT THE FEDERAL COURTS They will rarely allow an appeal from a probate court. The will say it is a State issue. Since when is the denial of your rights to your liberty and property without due process of the law as mandated by the 14th amendment not a federal issue? NOT THE STATE LEGISLATORS They have been told for 30 years this crime is happening and they remain mum on the issue—too many lawyers I guess NOT THE FEDERAL LEGISLATORS They have been told for 30 years that this crime is happening. Testimonies have been presented but they just look at their shoes and say it’s a shame but do nothing. They know your 14th amendment rights are violated and that you are being denied liberty and property under guardianship in our state courts without due process of law but they do nothing. In 1989 the Guardianship Rights and Responsibilities Act was submitted where Congress found that the 14th amendment rights were being violated but NOTHING was done and the bill was buried. NOT THE PROBATE COURT The judge will approve unlimited billings to be paid from your estate NOT THE ABA Of Course not their lawyers are getting paid with your money NOT THE AARP They are silent on the issue NOT THE ADA Even though you will be labeled as disabled and isolated from your community, home and loved ones, in utter violation of the integration mandate of title II of the American with Disabilities Act. NOT APS Adult Protective Services is that last people you want to report abuse and financial exploitation to because they will send you straight into a guardianship. NOT THE CRIMNAL JUSTICE SYSTEM It is a joke when it comes to elder abuse and guardianship abuse—They will just say it is a civil matter and leave you hanging in the guardianship court. NOT THE FBI Again they will say it is not a federal issue and they are not charged to look into this. THIS LIST COULD GO ON AND ON WE MUST STOP THIS NOW ! Give it away or give it to your heirs while you can. This is the sad reality. We are working for reform and demanding action be taken and the State and National Levels. They have known about this crime of financial exploitation and abuse under guardianships for over 25 years but no one is stopping it. So until we get some changes in the laws and they will protect the elderly and disabled victims of this crime then ………………… DON’T SAVE YOUR MONEY !!!! Unfortunately you are safer if you have no money. At least there is a better chance your kids will be allowed to be your guardian and to care for you and visit you. Yes, it is safer to be broke. So go on out and Have a Ball ! Go on that cruise ! Give your money to your kids ! Take a vacation ! Pay for the grandkids to go to College ! Don’t worry about being on Medicaid in the end because it isn’t really that bad and you will end up on it anyway after they take your money. In fact if you don’ t have money you will qualify for community services under Medicaid that you cannot get if you have too much money. So until our State and National Governments can get it right then DON’T SAVE YOUR MONEY !
